Make Your Business Entrance Ramp ADA Compliant

ADA Ramp Compliance

There are different types of ADA compliance ramps, but they all have one common goal: to make it easier for people with disabilities to access businesses and other public buildings. The law requires the use of an ada compliant ramp to make public spaces accessible to those using wheelchairs, walkers, and motorized scooters.

What Do the ADA's Ramp Requirements Include?

There are specific regulations that dictate the minimum width, maximum slope, and other design considerations for ADA ramps. In general, public ramps must be:

  • At least 36 inches wide and have a maximum slope of 1:12, which means that for every 12 inches of horizontal distance, the ramp must rise at most 1 inch.
  • Have handrails on both sides of the ramp if they are more than 30 inches above the ground.
  • Be made of a non-slip surface.
  • Have a level area at the top and bottom of the ramp for users to rest.
  • Have a contrasting color or other markings to help users identify the edge of the ramp.
  • Be designed and built to blend in with the overall design of the space.

There are some exceptions to these requirements, such as when a ramp is too small to meet the minimum width requirements or when it is located in a private residence. Cross-sloped ramp surfaces are also allowed in some cases.

ADA Driving and Parking Regulations

In addition to the requirements for ramps, the ADA also has regulations for driveways and parking lots. Drivers must be able to enter and exit the parking lot without difficulty, and there must be a designated handicap parking spot that is close to the entrance of the business. The aisle leading up to the handicap spot must be wide enough to accommodate a wheelchair, and there should be a sign indicating the location of the spot.

Driveways and parking lots must also meet certain slope requirements. The maximum permissible grade for a driveway is 6%, which means that for every 100 feet of horizontal distance, the driveway can rise no more than 6 feet. The maximum permissible grade for a parking lot is 3%, which means that for every 100 feet of horizontal distance, the parking lot can rise no more than 3 feet.

What Are the Penalties for Not Complying with the ADA's Ramp Requirements?

Ramps, driveways, and parking lots that do not meet these ADA requirements can be a liability for businesses. Not only can they result in fines, but they can also lead to lawsuits from customers or employees who are injured as a result of the non-compliance. In some cases, businesses may be required to make changes to their property to bring it into compliance with the ADA. Potential penalties for not complying with the ADA’s ramp requirements include:

  • Fines from the Department of Justice
  • Private lawsuits
  • Requests for changes from the Department of Justice
  • Injunctions from the court
  • Loss of federal funding

Compliance with the ADA’s ramp requirements is important not only to avoid penalties but also to ensure that public spaces are accessible to everyone.
